AI SAFE™
EMERGING RISK INTELLIGENCE
AI Safe™ Emerging Risk Intelligence — the risks you don't yet know are there.
Today's AI risks aren't always created by the decisions you make. They're often created by the technologies that quietly change around you.
Most AI guidance focuses on compliance with today's known responsibilities. AI Safe™ Emerging Risk Intelligence focuses on something different — the operational, legal and technological risks that emerge as AI capabilities evolve, often through software updates, new devices and changing platform features rather than deliberate business decisions.
Because the greatest AI risks are rarely announced. They arrive gradually, become normal, and are only recognised after they've become business problems.
Platforms introduce new capabilities
Consumer devices become workplace tools
Images become analysable
Audio becomes searchable
Video becomes evidence
Features that didn't exist six months ago quietly become part of everyday work.
"Are we using AI?""
Has AI changed what our organisation is exposed to?"
That's what Emerging Risk Intelligence helps you understand.
WHY THIS MATTERS
WHAT THIS COVERS
Four capabilities, not four policies
01
Emerging Technology
Understanding how new AI capabilities change operational risk before they become everyday practice.
02
Data Evolution
How ordinary business information can become sensitive through advances in AI analysis.
03
Human Behaviour
How new AI devices, assistants and embedded technologies change the way people work, without organisations deliberately introducing them.
04
Professional Responsibility
Understanding where responsibility remains with people, regardless of what AI recommends or automates.
INCLUDED IN THE PACK
Four operational guidance documents
Covering emerging areas of AI risk that the Starter Pack and Legal & Decision Pack do not.
CAPABILITY 01 · DATA EVOLUTION
Image & Biometric Risk
When ordinary photographs become far more than photographs.
CAPABILITY 03 · EMERGING TECHNOLOGY
Deepfakes & AI-Generated Content
Managing authenticity, disclosure and emerging legal responsibilities.
CAPABILITY 02 · HUMAN BEHAVIOUR
AI Wearables & Passive Capture
Understanding the implications of AI-enabled devices entering the workplace.
CAPABILITY 04 · PROFESSIONAL RESPONSIBILITY
Professional Boundaries
Knowing where AI assistance ends and professional judgement begins.
WHAT HAS CHANGED
AI changes faster than most organisations realise
Images
What looks like an ordinary photograph today may reveal biometric or health information tomorrow.
Wearables
Consumer AI devices increasingly capture information continuously, rather than only when activated.
AI-generated media
Synthetic content is becoming easier to create and harder to recognise.
Professional judgement
As AI recommendations improve, organisations must become clearer about where responsibility ultimately remains.
THREE OF THESE RISKS CARRY POTENTIAL
CRIMINAL LIABILITY — NOT JUST REGULATORY FINES
Using a wearable's live-listen feature directed at another person without their knowledge may constitute criminal interception under RIPA 2000 — maximum sentence, two years' imprisonment.
Creating intimate deepfake images without consent is a criminal offence under the Online Safety Act 2023. The offence does not require intent to harm.
Recording a consultation via smart glasses without disclosure creates potential RIPA 2000 exposure, regardless of whether the recording was intentional.
Has this technology changed since we last assessed it?
Is it collecting more information than we expect?
Could it create new responsibilities we haven't considered?
Does it change how our people work or make decisions?
Could we confidently explain why we decided this was appropriate?
Before introducing any new AI capability, answer all five — that's much closer to Infrastructure Intelligence than a compliance checklist.

APPLIED BEFORE EVERY EMERGING TECHNOLOGY DECISION
The Emerging Risk Review
Five questions, before the AI Decision Test — not instead of it. This isn't really a risk check any more. It's an awareness framework.
WHERE THESE RISKS SHOW UP
By sector
Aesthetic clinics
Before/after images are clinical records and likely Special Category Data. AI transformation imagery in marketing requires mandatory labelling. The 8-year clinical retention period applies to AI-processed images.
Therapists & coaches
AI transcription tools capture visual data from video sessions beyond audio. Any AI tool active during a session must be specifically disclosed to the client.
Personal trainers
Body composition images and progress photos may constitute health data when processed by AI. AI-generated programmes using health data require explicit Article 9 consent.
SME owners & managers
Staff use of wearable AI devices in meetings and client-facing settings creates institutional liability. Scope-of-practice applies wherever AI generates advice presented under your brand.
